Alimony, or spousal support, is an allowance that a person may be ordered to pay for the support and maintenance of a spouse or a former spouse, while they are living separate and apart or after an order for divorce, annulment or separate maintenance. There are several types of alimony. Spousal support in gross means a lump sum or periodic payments of a defined amount. Pendente lite support is support of a temporary period of time. Rehabilitative alimony is designed to temporarily support a spouse until he/she can be rehabilitated, or trained to do a specific job. Permanent alimony is designed to help a spouse who cannot be rehabilitated who has divorced/ been divorced after a lengthy marriage. Permanent alimony is becoming more and more uncommon.
The court considers many factors in determining alimony, including who is the dependant and who is the supporting spouse, if the alimony is equitable in the circumstances, and acts of marital misconduct. There are no real rules in determining alimony, though it is generally based on the parties’ income and their expenses.
